Terms and Conditions

These Terms and Conditions ("Terms") govern your purchase and use of Motion+ and MotionScore, provided by Motion Division Ltd ("we," "us," or "our"). By purchasing a license or starting a subscription, you agree to be bound by these Terms.
1. Motion+ (one-time purchase)
1.1. Scope of service: Motion+ is a package of premium APIs (including Ticker, Cursor, Carousel), Motion Examples source code, and access to Motion Studio.
1.2. License: Your purchase grants you a perpetual, non-exclusive license to use the Motion+ assets in your personal and commercial projects. This license includes lifetime updates for the product.
1.3. Fees: Motion+ is a one-time payment.
2. MotionScore (subscription)
2.1. Scope of service: MotionScore is a recurring subscription service providing ongoing access to [specific features/tools].
2.2. Billing: By signing up, you authorize us to charge your provided payment method on a monthly basis until you cancel.
2.3. Cancellation: You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access until the end of your current paid billing period, at which point your access will terminate.
3. Refund policy
3.1. Motion+: We offer a 7-day refund window from the date of purchase. If you are unsatisfied, please contact matt@motion.dev within this timeframe. After 7 days, all sales are final.
3.2. MotionScore: Monthly subscription fees are non-refundable. Because the service provides immediate access to digital content, you explicitly agree that by starting your subscription, you waive your statutory right of withdrawal and are not entitled to a refund for the current billing period.
4. Intellectual property
4.1. Ownership: Motion Division Ltd retains all right, title, and interest in and to Motion, Motion+, and MotionScore, including all associated code, logos, and trademarks.
4.2. Restrictions: You may not redistribute, resell, sublicense, or "bundle" the Motion+ source code or premium APIs as a standalone library or competing product.
5. Disclaimer and limitation of liability
5.1. "As is" basis: Our software and services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the services will be uninterrupted or error-free.
5.2. Liability: To the maximum extent permitted by law, Motion Division Ltd shall not be liable for any indirect, incidental, or consequential damages (including loss of profits or data) arising out of your use of our products. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
6. Governing law and jurisdiction
6.1. Governing law: These Terms are governed by and construed in accordance with the laws of the Netherlands.
6.2. Dispute resolution: Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in Amsterdam, the Netherlands.
7. Changes to terms
We reserve the right to modify these terms at any time. If a change is material, we will notify you via email or a notice on our website at least 30 days before the new terms take effect.
